Welcome to EroMusa(the "Site", "Service", "we", "us" or "our"). These Terms of Use (the "Terms") form a legally binding contract between you ("you" or the "User") and us. By accessing, browsing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

By using the Service, you represent and warrant that:

  • You are at least 18 years old.
  • You have the full power and authority to enter into this agreement.
  • You are not located in a country subject to a U.S. government embargo or that has been designated as a "terrorist supporting" country.
  • You are not listed on any U.S. government list of prohibited or restricted parties.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current and complete registration information.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Be responsible for all activity under your account.
  • Notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits and Payments

3.1 Virtual Credits

EroMusa operates on a credit-based system. Credits are purchased and deducted when you use the Service. Credits are non-refundable and non-transferable, except as expressly stated in our refund policy.

3.2 Payment Terms

All payments are processed by our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method. Prices are subject to change with notice.

3.3 No Free Trial

We do not offer free trials or test credits. All credits must be purchased.

3.4 Refund Policy

All sales are final. We do not offer refunds for purchased credits, except where required by applicable consumer law. If you believe you are entitled to a refund, please contact our support team.

4. Use of Service

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

4.2 Restrictions

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Modify, adapt, or hack the Service.
  • Use any robot, spider or automated device to access the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to any part of the Service.
  • Create derivative works based on the Service.
  • Resell or commercially exploit the Service without our written consent.

4.3 Content Standards

You agree that you will not upload, generate or share content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory or otherwise objectionable.
  • Infringes any third party's intellectual property rights.
  • Depicts real individuals without their consent.
  • Contains hate speech or promotes violence.
  • Depicts minors in any context.
  • Contains non-consensual intimate imagery (NCII).

5. Intellectual Property

5.1 Our IP

The Service, including its code, design, layout, graphics, and software, is owned by EroMusa and protected by copyright, trademark and other intellectual property laws. You may not copy, reproduce, distribute or create derivative works without our express written permission.

5.2 User Content

You retain ownership of the images you upload. You grant us a license to use your uploaded images solely for the purpose of providing the Service (e.g., generating videos). Generated videos are owned by you, subject to your compliance with these Terms.

5.3 Feedback

Any suggestions or feedback you provide may be used by us without compensation or obligation.

6. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, AI model providers). We are not responsible for the acts or omissions of these third parties. Your use of third-party services is subject to their respective terms.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases. Credits are non-refundable upon termination.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE ARE NOT RESPONSIBLE FOR THE QUALITY OR ACCURACY OF AI-GENERATED CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EROMUSA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT OR OTHERWISE.

10. Indemnification

You agree to indemnify and hold harmless EroMusa, its affiliates, officers, agents and employees from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Brazil.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
